All claims related to flight disruptions must be submitted and processed through Skycop\u2019s platform at <a href=\"https:\/\/www.skycop.com\" target=\"_blank\" rel=\"noopener\">https:\/\/www.skycop.com<\/a> (the \u201cSkycop Platform\u201d). Skycop handles all claims, legal proceedings, and related services. UK261, SHY Passenger v Turecku, ANAC v Braz\u00edlii nebo ekvivalent), v\u010detn\u011b v\u0161ech souvisej\u00edc\u00edch \u010d\u00e1stek, dan\u00ed a jin\u00fdch \u010d\u00e1stek, pokud cestuj\u00edc\u00ed nemohou let\u011bt nebo je jejich let naru\u0161en, a jak\u00e9koli pen\u011b\u017en\u00ed od\u0161kodn\u011bn\u00ed za ztracen\u00e1, zpo\u017ed\u011bn\u00e1 nebo po\u0161kozen\u00e1 zavazadla (\u201epostoupen\u00ed\u201c).<br>Pouze v p\u0159\u00edpad\u011b, \u017ee smlouva o postoupen\u00ed (formul\u00e1\u0159) nem\u016f\u017ee b\u00fdt v dan\u00e9 jurisdikci (zemi) pova\u017eov\u00e1na za platnou nebo pokud se strany dohodnou na poskytov\u00e1n\u00ed slu\u017eeb samostatnou smlouvou, bude smlouva uzav\u0159en\u00e1 mezi klientem a spole\u010dnost\u00ed Skycop pova\u017eov\u00e1na za smlouvu o poskytov\u00e1n\u00ed slu\u017eeb, na z\u00e1klad\u011b kter\u00e9 spole\u010dnost Skycop spravuje postoupen\u00ed klienta a zavazuje se zorganizovat a financovat vym\u00e1h\u00e1n\u00ed postoupen\u00ed a prov\u00e9st v\u0161echny dal\u0161\u00ed \u00fakony souvisej\u00edc\u00ed se smlouvou. Aby bylo pou\u017eit\u00ed a v\u00fdklad obchodn\u00edch podm\u00ednek snaz\u0161\u00ed, definice smlouvy kombinuje smlouvu o postoupen\u00ed a smlouvu o poskytov\u00e1n\u00ed slu\u017eeb a pr\u00e1vn\u00ed vztah postoupen\u00ed a poskytov\u00e1n\u00ed slu\u017eeb se ozna\u010duje jako slu\u017eby, pokud nen\u00ed v\u00fdslovn\u011b uvedeno jinak.   <\/li><li aria-level=\"1\">N\u00e1rok: Jak\u00fdkoli n\u00e1rok v\u016f\u010di provozovateli letu (leteck\u00e9 spole\u010dnosti) na finan\u010dn\u00ed od\u0161kodn\u011bn\u00ed podle na\u0159\u00edzen\u00ed o od\u0161kodn\u011bn\u00ed za let.<\/li><li aria-level=\"1\">Klient: Osoba, kter\u00e1 si zakoupila \u010dlenstv\u00ed TravelCare, p\u0159ijala tyto VOP a \u017e\u00e1d\u00e1 o kompenzaci za let nebo jin\u00e9 v\u00fdhody.<\/li><li aria-level=\"1\">Na\u0159\u00edzen\u00ed o elektronick\u00e9 identifikaci: Na\u0159\u00edzen\u00ed Evropsk\u00e9ho parlamentu a Rady (EU) \u010d. 910\/2014 ze dne 23. \u010dervence 2014 o elektronick\u00e9 identifikaci a d\u016fv\u011bryhodn\u00fdch slu\u017eb\u00e1ch pro elektronick\u00e9 transakce na vnit\u0159n\u00edm trhu a o zru\u0161en\u00ed sm\u011brnice 1999\/93\/ES.<\/li><li aria-level=\"1\">Kompenzace za let: Celkov\u00e1 \u010d\u00e1stka vyplacen\u00e1 provozovatelem letu v souvislosti s n\u00e1rokem jako kompenzace, vyrovn\u00e1n\u00ed nebo gesto dobr\u00e9 v\u016fle, v\u010detn\u011b dodate\u010dn\u00fdch v\u00fddaj\u016f kompenzovan\u00fdch podle uv\u00e1\u017een\u00ed dopravce pot\u00e9, co klient p\u0159ijal tyto VOP. Skycop nab\u00edz\u00ed \u010dlenstv\u00ed TravelCare jako: (i) p\u0159edplatn\u00e9 na jednu rezervaci; (ii) m\u011bs\u00ed\u010dn\u00ed, \u010dtvrtletn\u00ed, pololetn\u00ed nebo ro\u010dn\u00ed p\u0159edplatn\u00e9; nebo (iii) rodinn\u00e9 p\u0159edplatn\u00e9 pro a\u017e p\u011bt osob. \u010clenstv\u00ed zahrnuje n\u00e1rok na od\u0161kodn\u011bn\u00ed a p\u0159\u00edstup do sal\u00f3nku SmartDelay v r\u00e1mci rezervace nebo obdob\u00ed, pro kter\u00e9 bylo zakoupeno.    <\/p><p>2.4. \u010clenstv\u00ed v TravelCare za\u010d\u00edn\u00e1 dnem zakoupen\u00ed. \u010clenstv\u00ed v TravelCare jako m\u011bs\u00ed\u010dn\u00ed, ro\u010dn\u00ed, pololetn\u00ed nebo \u010dtvrtletn\u00ed p\u0159edplatn\u00e9 bude \u00fa\u010dtov\u00e1no m\u011bs\u00ed\u010dn\u011b, ro\u010dn\u011b, pololetn\u011b nebo \u010dtvrtletn\u011b a bude automaticky prodlou\u017eeno o jeden m\u011bs\u00edc, jeden rok, \u0161est m\u011bs\u00edc\u016f nebo t\u0159i m\u011bs\u00edce, dokud \u010dlen nezru\u0161\u00ed \u010dlenstv\u00ed v TravelCare. Zru\u0161en\u00e9 p\u0159edplatn\u00e9 z\u016fstane aktivn\u00ed po dobu, za kterou \u010dlen TravelCare zaplatil. Pokud \u010dlen TravelCare zakoup\u00ed \u010dlenstv\u00ed TravelCare pro jin\u00e9 osoby nebo rodinn\u00e9 p\u0159edplatn\u00e9, bude vystavena jedna faktura pouze \u010dlenovi a pouze \u010dlenovi TravelCare bude \u00fa\u010dtov\u00e1no \u010dlenstv\u00ed TravelCare a jeho automatick\u00e9 prodlou\u017een\u00ed. V p\u0159\u00edpad\u011b rodinn\u00e9ho p\u0159edplatn\u00e9ho bude organiz\u00e1tor rodinn\u00e9ho p\u0159edplatn\u00e9ho odpov\u011bdn\u00fd za platby a organizaci p\u0159edplatn\u00e9ho, jako je p\u0159id\u00e1v\u00e1n\u00ed a odeb\u00edr\u00e1n\u00ed \u010dlen\u016f, prodlou\u017een\u00ed a zru\u0161en\u00ed p\u0159edplatn\u00e9ho.    <\/p><p>2.5. Po zakoupen\u00ed obdr\u017e\u00ed \u010dlen TravelCare potvrzovac\u00ed e-mail.<\/p><p>2.6. Pro \u010dleny Skycop upou\u0161t\u00ed od sv\u00e9 odm\u011bny (pokud je to relevantn\u00ed) za vy\u0159izov\u00e1n\u00ed n\u00e1rok\u016f a vym\u00e1h\u00e1n\u00ed leteck\u00e9ho od\u0161kodn\u011bn\u00ed, na kter\u00e9 se vztahuje \u010dlenstv\u00ed TravelCare. N\u00e1roky mus\u00ed b\u00fdt pod\u00e1ny prost\u0159ednictv\u00edm platformy Skycop. <\/p><p>2.7. V\u00fdhody jsou osobn\u00ed a vztahuj\u00ed se pouze na \u010dlena TravelCare (nebo na cestuj\u00edc\u00ed zahrnut\u00e9 ve stejn\u00e9 rezervaci, a\u017e do limitu pl\u00e1nu). \u010clen TravelCare mus\u00ed b\u00fdt uveden jako cestuj\u00edc\u00ed. <\/p><p>2.8. Odm\u011bna se nevrac\u00ed za lety, kter\u00e9 byly naru\u0161eny p\u0159ed zah\u00e1jen\u00edm \u010dlenstv\u00ed v programu TravelCare.<\/p><p>2.9. \u010clenstv\u00ed v TravelCare je nep\u0159enosn\u00e9. Jak\u00e9koli neopr\u00e1vn\u011bn\u00e9 pou\u017eit\u00ed nahlaste spole\u010dnosti Skycop na adrese <a href=\"mailto:support@skycop.com\">support@skycop.com<\/a>. <\/p><p>2.10. Ceny se nevrac\u00ed, pokud nedojde k \u017e\u00e1dn\u00e9mu naru\u0161en\u00ed, slu\u017eby nejsou vyu\u017eity nebo nen\u00ed vr\u00e1cena n\u00e1hrada.<\/p><p>2.11. \u010clen Travelcare mus\u00ed podat \u017e\u00e1dost o n\u00e1hradu \u0161kody spole\u010dnosti Skycop do 12 m\u011bs\u00edc\u016f od data letu, pro kter\u00fd bylo \u010dlenstv\u00ed TravelCare zakoupeno. \u010clenstv\u00ed TravelCare vypr\u0161\u00ed po 12 m\u011bs\u00edc\u00edch od data letu, pro kter\u00fd bylo \u010dlenstv\u00ed Skycop Care zakoupeno. <\/p><p>2.12. Po zru\u0161en\u00ed nebo vypr\u0161en\u00ed platnosti Skycop ji\u017e neupou\u0161t\u00ed od n\u00e1roku na odm\u011bnu a p\u0159\u00edstup ke slu\u017eb\u011b SmartDelay bude ukon\u010den.<\/p><p>2.13. Skycop si vyhrazuje pr\u00e1vo odm\u00edtnout \u010dlenstv\u00ed v programu TravelCare.<\/p><p>2.14. P\u0159i pod\u00e1n\u00ed \u017e\u00e1dosti o n\u00e1hradu \u0161kody p\u0159edlo\u017ete doklad o \u010dlenstv\u00ed v programu TravelCare (nap\u0159. potvrzovac\u00ed e-mail).<\/p><p>2.15. Slu\u017ebu TravelCare je nutn\u00e9 aktivovat nejm\u00e9n\u011b 24 hodin p\u0159ed odletem. N\u00e1roky se pod\u00e1vaj\u00ed po letu prost\u0159ednictv\u00edm platformy Skycop, kde jsou n\u00e1kupy slu\u017eby TravelCare automaticky rozpozn\u00e1ny. <\/p><p>2.16. To access SmartDelay, TravelCare members must register their flight at least 2 hours before the scheduled departure time, as specified in the <a href=\"http:\/\/travelwithcare.io\/cs\/smartdelay-terms-and-conditions\/\">SmartDelay Terms and Conditions<\/a>. SmartDelay is subject to availability and eligibility criteria managed by Collinson Service Solutions Limited. The SmartDelay service is provided free of charge to TravelCare members.<\/p><p>2.17. Personal data provided via the TravelCare Website is collected and processed in accordance with the <a href=\"http:\/\/travelwithcare.io\/cs\/zasady-ochrany-osobnich-udaju\/\">TravelCare Privacy Policy<\/a>. In the event of a service being triggered (e.g. flight disruption claims), such data will subsequently be processed under Skycop\u2019s <a href=\"http:\/\/travelwithcare.io\/cs\/zasady-ochrany-osobnich-udaju\/\">Privacy Policy.<\/a> For the SmartDelay service specifically, personal data is also processed by Collinson Service Solutions Limited in accordance with the <a href=\"http:\/\/travelwithcare.io\/cs\/smartdelay-terms-and-conditions\/\">SmartDelay Privacy Policy<\/a>.<\/p><p>2.18. V\u00fdhody TravelCare nezaru\u010duj\u00ed n\u00e1hradu \u0161kody, n\u00e1rok na ni z\u00e1vis\u00ed na platn\u00fdch p\u0159edpisech. Skycop spravuje opr\u00e1vn\u011bn\u00e9 n\u00e1roky bez dal\u0161\u00edch n\u00e1klad\u016f, v\u010detn\u011b soudn\u00edch \u0159\u00edzen\u00ed, pokud je to nutn\u00e9. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-78cefbb fitst-box elementor-widget elementor-widget-text-editor\" data-id=\"78cefbb\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"eia\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>Uzav\u0159en\u00ed smlouvy<\/h3><p>3.1. Zakoupen\u00edm \u010dlenstv\u00ed TravelCare a pod\u00e1n\u00edm \u017e\u00e1dosti o n\u00e1hradu \u0161kody prost\u0159ednictv\u00edm platformy Skycop klient oprav\u0148uje spole\u010dnost Skycop k posouzen\u00ed opr\u00e1vn\u011bnosti \u017e\u00e1dosti o n\u00e1hradu \u0161kody za let nebo k poskytnut\u00ed dal\u0161\u00edch v\u00fdhod TravelCare, jako je nap\u0159\u00edklad p\u0159\u00edstup do sal\u00f3nku SmartDelay.<\/p><p>3.2. Skycop vyu\u017e\u00edv\u00e1 online ov\u011b\u0159ovac\u00ed slu\u017ebu pro pokro\u010dil\u00e9 elektronick\u00e9 podpisy, kter\u00e1 spl\u0148uje po\u017eadavky stanoven\u00e9 v \u010dl\u00e1nku 26 na\u0159\u00edzen\u00ed o elektronick\u00e9 identifikaci, kter\u00e9 je mezin\u00e1rodn\u011b uzn\u00e1van\u00e9 a akceptovan\u00e9 i soudy, tak\u017ee klient nemus\u00ed smlouvu tisknout, podepisovat a zas\u00edlat zp\u011bt doporu\u010denou po\u0161tou.<\/p><p>3.3. Podpisem smlouvy a souhlasem s obchodn\u00edmi podm\u00ednkami klient potvrzuje, \u017ee nebude udr\u017eovat \u017e\u00e1dn\u00fd p\u0159\u00edm\u00fd kontakt s provozovatelem ani p\u0159ij\u00edmat platby od provozovatele.<\/p><p>3.4. Skycop evaluates Claims submitted via the Skycop Platform and decides whether to accept them or reject them based on eligibility, however, the result of such assessment does not include any binding statement and does not guarantee successful enforcement of the Claim. If, after assessing the merits of the Claim, the legal representative considers that pursuit of the Claim during Legal Proceedings is unlikely to succeed, the Client will be informed and Skycop will pursue the Claim no further. Such notification of the Client shall mean that the collection of the Flight Compensation has ended and full ownership and legal title to the Assignment is automatically returned to the Client without conclusion of additional agreements. For SmartDelay, eligibility is determined by Collinson Service Solutions Limited in accordance with the SmartDelay <a href=\"http:\/\/travelwithcare.io\/cs\/smartdelay-terms-and-conditions\/\">SmartDelayTerms and Conditions<\/a>.<\/p><p>3.5. Pokud je reklamace p\u0159ijata, Skycop ji \u0159e\u0161\u00ed mimosoudn\u011b nebo soudn\u00ed cestou (podle uv\u00e1\u017een\u00ed Skycopu) a hrad\u00ed v\u0161echny n\u00e1klady. Klient bere na v\u011bdom\u00ed, \u017ee vy\u0159\u00edzen\u00ed reklamace m\u016f\u017ee trvat zna\u010dnou dobu a \u017ee Skycop nem\u016f\u017ee ovlivnit, jak rychle bude reklamace vy\u0159\u00edzena. Skycop m\u00e1 v\u00fdhradn\u00ed pr\u00e1vo p\u0159ijmout a\/nebo odm\u00edtnout jakoukoli nab\u00eddku na mimosoudn\u00ed vyrovn\u00e1n\u00ed na z\u00e1klad\u011b sv\u00fdch zku\u0161enost\u00ed s p\u0159\u00edslu\u0161n\u00fdm leteck\u00fdm dopravcem. Tato smlouva se pova\u017euje za dostate\u010dn\u00fd pr\u00e1vn\u00ed z\u00e1klad pro \u00fa\u010dinnost tohoto pr\u00e1va.   <\/p><p>3.6. B\u011bhem soudn\u00edho \u0159\u00edzen\u00ed bude pr\u00e1vn\u00edmu z\u00e1stupci spole\u010dnosti Skycop umo\u017en\u011bn p\u0159\u00edstup ke v\u0161em \u00fadaj\u016fm, kter\u00e9 klient poskytl spole\u010dnosti Skycop za \u00fa\u010delem uplatn\u011bn\u00ed n\u00e1roku. Pokud t\u0159et\u00ed strany po\u017eaduj\u00ed dal\u0161\u00ed dokumenty prokazuj\u00edc\u00ed opr\u00e1vn\u011bn\u00ed pr\u00e1vn\u00edho z\u00e1stupce, klient na pokyn spole\u010dnosti Skycop neprodlen\u011b poskytne pr\u00e1vn\u00edmu z\u00e1stupci v\u0161echny takov\u00e9 dokumenty. Pokud je pro \u00fasp\u011b\u0161n\u00e9 z\u00edsk\u00e1n\u00ed leteck\u00e9 kompenzace nezbytn\u00e9, aby n\u00e1rok byl pod\u00e1n pr\u00e1vn\u00edm z\u00e1stupcem (nap\u0159. advok\u00e1tem) jm\u00e9nem klienta, klient podep\u00ed\u0161e p\u0159\u00edslu\u0161nou smlouvu s pr\u00e1vn\u00edm z\u00e1stupcem a pen\u011b\u017en\u00ed n\u00e1rok klienta bude p\u0159eveden zp\u011bt na klienta od okam\u017eiku uzav\u0159en\u00ed p\u0159\u00edslu\u0161n\u00e9 smlouvy s pr\u00e1vn\u00edm z\u00e1stupcem. V takov\u00e9m p\u0159\u00edpad\u011b se klient a Skycop dohodnou mezi sebou podle podm\u00ednek stanoven\u00fdch v t\u011bchto VOP a (nebo) jin\u00e9 smlouv\u011b uzav\u0159en\u00e9 mezi klientem a Skycop.   <\/p><p>3.7. Spole\u010dnost Skycop je opr\u00e1vn\u011bna p\u0159ij\u00edmat pouze kompenzace za let, nep\u0159ij\u00edm\u00e1 \u017e\u00e1dn\u00e9 cestovn\u00ed pouk\u00e1zky ani jin\u00e9 slu\u017eby, kter\u00e9 m\u016f\u017ee nab\u00edzet provozovatel letu. Spole\u010dnost Skycop vyplat\u00ed klientovi z\u00edskanou kompenzaci za let po jej\u00edm z\u00edsk\u00e1n\u00ed. <\/p><p>3.8. Klient potvrzuje a prohla\u0161uje, \u017ee VOP jsou p\u0159\u00edm\u00fdm d\u016fkazem a vyj\u00e1d\u0159en\u00edm skute\u010dn\u00e9 v\u016fle a mus\u00ed b\u00fdt respektov\u00e1ny leteck\u00fdmi dopravci. Klient souhlas\u00ed se spole\u010dnost\u00ed Skycop, \u017ee v\u0161echny platby kompenzace za let proveden\u00e9 leteck\u00fdmi dopravci na z\u00e1klad\u011b n\u00e1rok\u016f spole\u010dnosti Skycop by m\u011bly b\u00fdt prov\u00e1d\u011bny p\u0159\u00edmo na bankovn\u00ed \u00fa\u010dty vlastn\u011bn\u00e9 spole\u010dnost\u00ed Skycop nebo na jin\u00e9 bankovn\u00ed \u00fa\u010dty podle dohody mezi spole\u010dnost\u00ed Skycop a klientem. <\/p><p>3.9. Pokud je n\u00e1rok ne\u00fasp\u011b\u0161n\u00fd, klientovi nejsou \u00fa\u010dtov\u00e1ny \u017e\u00e1dn\u00e9 poplatky, ale \u010dlensk\u00e9 poplatky TravelCare z\u016fst\u00e1vaj\u00ed nevratn\u00e9.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fb2f00d elementor-widget elementor-widget-text-editor\" data-id=\"fb2f00d\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"coc\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>Spolupr\u00e1ce ze strany klienta<\/h3><p>4.1. Klient se zavazuje poskytnout spole\u010dnosti Skycop ve\u0161ker\u00e9 \u00fadaje a dokumenty, kter\u00e9 jsou nezbytn\u00e9 pro vy\u0159\u00edzen\u00ed reklamace. Klient zaru\u010duje, \u017ee \u00fadaje a informace poskytnut\u00e9 spole\u010dnost\u00ed Skycop v souvislosti s reklamac\u00ed jsou spr\u00e1vn\u00e9, \u00fapln\u00e9, pravdiv\u00e9 a nezav\u00e1d\u011bj\u00edc\u00ed. Klient je povinen od\u0161kodnit spole\u010dnost Skycop za ve\u0161ker\u00e9 n\u00e1roky, kter\u00e9 vznikly v d\u016fsledku nespr\u00e1vn\u00fdch informac\u00ed poskytnut\u00fdch klientem a\/nebo nedostate\u010dn\u00e9 \u010di nespr\u00e1vn\u00e9 spolupr\u00e1ce ze strany klienta.  <\/p><p>4.2. Uzav\u0159en\u00edm smlouvy klient potvrzuje, \u017ee je opr\u00e1vn\u011bn a m\u00e1 pr\u00e1vn\u00ed zp\u016fsobilost podepisovat dokumenty z\u00e1vazn\u00e9 pro Skycop i klienta, nebo, je-li to relevantn\u00ed, m\u00e1 pr\u00e1vo podepisovat jm\u00e9nem jin\u00e9 osoby (nap\u0159. d\u00edt\u011bte).<\/p><p>4.3. Klient zaru\u010duje, \u017ee postoupen\u00ed n\u00e1roku na leteck\u00e9 od\u0161kodn\u011bn\u00ed nebylo postoupeno t\u0159et\u00edm stran\u00e1m a \u017ee nebyla uzav\u0159ena \u017e\u00e1dn\u00e1 jin\u00e1 dohoda t\u00fdkaj\u00edc\u00ed se od\u0161kodn\u011bn\u00ed a \u017ee mezi klientem a provozovatelem letu neprob\u00edh\u00e1 ani se neo\u010dek\u00e1v\u00e1 \u017e\u00e1dn\u00fd pr\u00e1vn\u00ed spor t\u00fdkaj\u00edc\u00ed se stejn\u00e9 z\u00e1le\u017eitosti. Klient bere na v\u011bdom\u00ed, \u017ee proveden\u00edm postoupen\u00ed nesm\u00ed uzav\u0159\u00edt stejnou a\/nebo podobnou dohodu, v\u010detn\u011b spole\u010dnost\u00ed konkuruj\u00edc\u00edch Skycop, ani podnikat pr\u00e1vn\u00ed kroky v souvislosti s vym\u00e1h\u00e1n\u00edm leteck\u00e9ho od\u0161kodn\u011bn\u00ed. <\/p><p>4.4. For SmartDelay lounge acces, the client shall provide accurate flight details at least 2 hours before scheduled departure, as required by Collinson Service Solutions Limited, and comply with the <a href=\"http:\/\/travelwithcare.io\/cs\/smartdelay-terms-and-conditions\/\">SmartDelay Terms and Conditions<\/a>.<\/p><p>4.5. Pokud klient obdr\u017e\u00ed jakoukoli platbu nebo jak\u00fdkoli jin\u00fd typ kompenzace za let, nap\u0159. leteck\u00fd voucher, od provozovatele letu po vyu\u017eit\u00ed slu\u017eeb Skycop, je klient povinen o tom neprodlen\u011b informovat Skycop.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5244dba fitst-box elementor-widget elementor-widget-text-editor\" data-id=\"5244dba\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"rap\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>Odm\u011bny a platby<\/h3><p>5.1. Skycop uplat\u0148uje n\u00e1rok bezplatn\u011b. Pokud je n\u00e1rok \u00fasp\u011b\u0161n\u00fd a je obdr\u017eena kompenzace za let, je klientovi vyplacena cel\u00e1 \u010d\u00e1stka kompenzace za let. <\/p><p>5.2. Pokud klient podvodn\u011b poskytne nespr\u00e1vn\u00e9 nebo ne\u00fapln\u00e9 \u00fadaje a spole\u010dnosti Skycop t\u00edm vzniknou dodate\u010dn\u00e9 n\u00e1klady, klient je povinen tyto n\u00e1klady spole\u010dnosti Skycop uhradit.<\/p><p>5.3. Pokud klient poskytl nespr\u00e1vn\u00e9 nebo nedostate\u010dn\u00e9 informace pot\u0159ebn\u00e9 k vyplacen\u00ed leteck\u00e9 kompenzace a ta byla vr\u00e1cena spole\u010dnosti Skycop, m\u00e1 Skycop pr\u00e1vo ode\u010d\u00edst v\u0161echny dodate\u010dn\u00e9 n\u00e1klady, kter\u00e9 spole\u010dnosti Skycop vznikly. Pokud klient poskytl nespr\u00e1vn\u00e9 nebo nedostate\u010dn\u00e9 informace pot\u0159ebn\u00e9 k vyplacen\u00ed leteck\u00e9 kompenzace a (nebo) je tato kompenzace vr\u00e1cena spole\u010dnosti Skycop a klient po upom\u00ednk\u00e1ch a p\u0159im\u011b\u0159en\u00fdch snah\u00e1ch spole\u010dnosti Skycop kontaktovat klienta prost\u0159ednictv\u00edm prost\u0159edk\u016f, kter\u00e9 klient spole\u010dnosti Skycop poskytl, neoprav\u00ed nebo neposkytne informace pot\u0159ebn\u00e9 k vyplacen\u00ed leteck\u00e9 kompenzace, m\u00e1 spole\u010dnost Skycop pr\u00e1vo si leteckou kompenzaci, kter\u00e1 by jinak m\u011bla b\u00fdt klientovi vyplacena, ponechat. <\/p><p>5.4. U \u00fa\u010dt\u016f v jednotn\u00e9 oblasti pro platby v eurech (SEPA) budou v\u0161echny platby zas\u00edl\u00e1ny na \u00fa\u010det bankovn\u00edm p\u0159evodem. P\u0159i prov\u00e1d\u011bn\u00ed mezin\u00e1rodn\u00edho p\u0159evodu klientovi budou v\u0161echny bankovn\u00ed poplatky ode\u010dteny z kompenzace za let. <\/p><p>5.5. Aby se u\u0161et\u0159ily bankovn\u00ed n\u00e1klady, v p\u0159\u00edpad\u011b spole\u010dn\u00e9 rezervace nebo v jin\u00fdch p\u0159\u00edpadech (nap\u0159. rodi\u010de dost\u00e1vaj\u00ed platby za d\u011bti), Skycop p\u0159evede v\u0161echny platby na jeden \u00fa\u010det, pokud to klient Skycopu povol\u00ed nebo pokud je p\u0159i zad\u00e1v\u00e1n\u00ed \u00fadaj\u016f Skycopu uveden jeden \u00fa\u010det. Osoba, kter\u00e1 obdr\u017eela pen\u00edze za jin\u00e9 osoby, je povinna s nimi vy\u00fa\u010dtovat, a v takov\u00e9m p\u0159\u00edpad\u011b Skycop nep\u0159eb\u00edr\u00e1 riziko neuhrazen\u00ed platby. <\/p><p>5.6. Spole\u010dnost Skycop nenese odpov\u011bdnost za \u017e\u00e1dn\u00e9 \u0161eky, p\u0159edplacen\u00e9 debetn\u00ed karty, kreditn\u00ed karty a podobn\u00e9 prost\u0159edky, kter\u00e9 klient ztrat\u00ed, ani za \u017e\u00e1dn\u00e9 d\u016fsledky vypl\u00fdvaj\u00edc\u00ed z toho, \u017ee klient uvedl nespr\u00e1vn\u00e9 bankovn\u00ed \u00fadaje.<\/p><p>5.7. Pokud je to povinn\u00e9, Skycop poskytne elektronickou fakturu nebo jin\u00fd dokument prost\u0159ednictv\u00edm e-mailu.<\/p><p>5.8. Spole\u010dnost Skycop nenese odpov\u011bdnost za neproplacen\u00ed dohodnut\u00e9 kompenzace za let z d\u016fvodu okolnost\u00ed, kter\u00e9 jsou mimo jej\u00ed p\u0159im\u011b\u0159enou kontrolu, v\u010detn\u011b, ale nikoli v\u00fdlu\u010dn\u011b, st\u00e1vky, v\u00fdluky, pracovn\u00edho sporu, vy\u0161\u0161\u00ed moci, v\u00e1lky, nepokoj\u016f, dodr\u017eov\u00e1n\u00ed z\u00e1kona nebo vl\u00e1dn\u00edho na\u0159\u00edzen\u00ed, pravidla, p\u0159edpisu atd.<\/p><p>5.9. Kompenzace za let a jak\u00e9koli jin\u00e9 platby budou spole\u010dnost\u00ed Skycop vyplaceny pouze kone\u010dn\u00fdm p\u0159\u00edjemc\u016fm, kte\u0159\u00ed maj\u00ed n\u00e1rok na kompenzaci za let. Spole\u010dnost Skycop nevyplat\u00ed kompenzaci za let a (nebo) jak\u00e9koli jin\u00e9 platby zprost\u0159edkovatel\u016fm, agentur\u00e1m, z\u00e1stupc\u016fm a (nebo) jin\u00fdm t\u0159et\u00edm stran\u00e1m, kter\u00e9 spolu s \u017e\u00e1dost\u00ed o v\u00fdplatu kompenzace za let neposkytnou \u017e\u00e1dn\u00fd konkr\u00e9tn\u00ed p\u00edsemn\u00fd doklad, kter\u00fd by jasn\u011b a jednozna\u010dn\u011b potvrzoval opr\u00e1vn\u011bn\u00ed p\u0159ij\u00edmat platby jm\u00e9nem kone\u010dn\u00e9ho p\u0159\u00edjemce. V p\u0159\u00edpad\u011b jak\u00fdchkoli pochybnost\u00ed ohledn\u011b pr\u00e1va na p\u0159ijet\u00ed plateb m\u00e1 spole\u010dnost Skycop pr\u00e1vo po\u017eadovat dodate\u010dn\u00fd d\u016fkaz potvrzuj\u00edc\u00ed pr\u00e1vo p\u0159ij\u00edmat platby jm\u00e9nem kone\u010dn\u00fdch p\u0159\u00edjemc\u016f a (nebo) jednostrann\u011b odm\u00edtnout vyplatit leteckou kompenzaci p\u0159\u00edmo takov\u00e9 osob\u011b.  <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f21bf4b fitst-box elementor-widget elementor-widget-text-editor\" data-id=\"f21bf4b\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"ter\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>Ukon\u010den\u00ed<\/h3><p>6.1. Spole\u010dnost Skycop m\u016f\u017ee smlouvu okam\u017eit\u011b vypov\u011bd\u011bt z d\u016fvodu podstatn\u00e9ho poru\u0161en\u00ed smlouvy ze strany klienta. V takov\u00e9m p\u0159\u00edpad\u011b bude klientovi vr\u00e1cena \u010d\u00e1st poplatku zaplacen\u00e9ho za \u010dlenstv\u00ed, a to v pom\u011bru k dob\u011b zb\u00fdvaj\u00edc\u00ed do vypr\u0161en\u00ed \u010dlenstv\u00ed, po ode\u010dten\u00ed p\u0159im\u011b\u0159en\u00fdch p\u0159\u00edm\u00fdch ztr\u00e1t, kter\u00e9 spole\u010dnosti Skycop vznikly v d\u016fsledku nedodr\u017een\u00ed smlouvy. <\/p><p>6.2. Members who are considered consumers under the EU consumer laws and who have purchased their Membership remotely may withdraw from their Membership within 14 days of the date of purchase without giving any reason. To exercise the right of withdrawal and receive a full refund, the withdrawal must be notified within 14 days from the date of purchase and clearly stated that the Member wishes to withdraw from TravelCare Membership. The withdrawal notice may be sent to: <a href=\"mailto:support@skycop.com\">support@skycop.com<\/a>. If the Member travelled on any flight related to the Membership that was disrupted and for which the Member contacted Skycop, the Member can no longer cancel the Skycop Care Membership under the procedure set out in this section.<\/p><p>6.3. Po uplynut\u00ed v\u00edce ne\u017e 14 dn\u016f od zakoupen\u00ed \u010dlenstv\u00ed TravelCare m\u00e1 \u010dlen pr\u00e1vo \u010dlenstv\u00ed zru\u0161it, ale nem\u00e1 n\u00e1rok na vr\u00e1cen\u00ed ceny \u010dlenstv\u00ed TravelCare. Tato \u010d\u00e1stka se pova\u017euje za poplatek za ukon\u010den\u00ed \u010dlenstv\u00ed a tento poplatek za ukon\u010den\u00ed \u010dlenstv\u00ed se pova\u017euje za p\u0159edem dohodnutou n\u00e1hradu za p\u0159\u00edm\u00e9 ztr\u00e1ty a nezbytn\u00e9 v\u00fddaje, kter\u00e9 spole\u010dnosti Skycop vznikly v d\u016fsledku ukon\u010den\u00ed \u010dlenstv\u00ed p\u0159ed jeho vypr\u0161en\u00edm.  <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8a29da5 fitst-box elementor-widget elementor-widget-text-editor\" data-id=\"8a29da5\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"fip\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>Z\u00e1v\u011bre\u010dn\u00e1 ustanoven\u00ed<\/h3><p>7.1. Spole\u010dnost Skycop m\u00e1 pr\u00e1vo kdykoli zm\u011bnit VOP nebo poskytnout dodate\u010dn\u00e9 VOP z d\u016fle\u017eit\u00fdch d\u016fvod\u016f, jako jsou: vylep\u0161en\u00ed informa\u010dn\u00edch syst\u00e9m\u016f a\/nebo technologi\u00ed, zm\u011bny v legislativ\u011b, za \u00fa\u010delem vyjasn\u011bn\u00ed, \u00fapravy nebo vylep\u0161en\u00ed VOP.<\/p><p>7.2. Ka\u017ed\u00fd klient bude informov\u00e1n o zm\u011bn\u00e1ch VOP, kter\u00e9 se na n\u011bj vztahuj\u00ed, jejich zve\u0159ejn\u011bn\u00edm na webov\u00fdch str\u00e1nk\u00e1ch Skycop, jako\u017e i zasl\u00e1n\u00edm e-mailu klientovi a\/nebo poskytnut\u00edm informac\u00ed v \u00fa\u010dtu klienta.<\/p><p>7.3. Zm\u011bny VOP platn\u00e9 pro klienta vstoup\u00ed v platnost nejd\u0159\u00edve 7 kalend\u00e1\u0159n\u00edch dn\u016f pot\u00e9, co byl klient \u0159\u00e1dn\u011b informov\u00e1n o zm\u011bn\u00e1ch VOP. Pokud klient se zm\u011bnami VOP nesouhlas\u00ed, m\u00e1 pr\u00e1vo smlouvu vypov\u011bd\u011bt, a to zasl\u00e1n\u00edm e-mailu spole\u010dnosti Skycop ve lh\u016ft\u011b stanoven\u00e9 v tomto odstavci. <\/p><p>7.4. The laws of the Republic of Lithuania apply to the T&amp;C, the Agreement and\/or any other document concluded in relation to the T&amp;C and the Agreement, except if otherwise agreed in the specific document. The SmartDelay service is governed by English law, as detailed in the <a href=\"http:\/\/travelwithcare.io\/cs\/smartdelay-terms-and-conditions\/\">SmartDelay Terms and Conditions<\/a>. The Client (consumer) is also entitled to claim protection under mandatory provisions provided by the laws of the country where the Client (consumer) resides.  <\/p><p>7.5. Skycop will use the Client\u2019s and, if applicable, its employees\u2019 personal data exclusively for enforcing the Claim. Any and all information regarding the extent and form of data collection, storage and usage of personal data can be found in <a href=\"http:\/\/travelwithcare.io\/cs\/zasady-ochrany-osobnich-udaju\/\">Skycop\u2019s Privacy Policy<\/a>. <\/p><p>7.6. V p\u0159\u00edpad\u011b, \u017ee je klient pr\u00e1vnickou osobou, zaru\u010duje a prohla\u0161uje, \u017ee:<\/p><p>&#8211; osobn\u00ed \u00fadaje poskytnut\u00e9 Skycopu byly shrom\u00e1\u017ed\u011bny a budou Skycopu poskytov\u00e1ny v\u017edy v souladu s po\u017eadavky na ochranu soukrom\u00ed a osobn\u00edch \u00fadaj\u016f;<\/p><p>&#8211; pro \u00fa\u010dely t\u00e9to smlouvy je Skycop spr\u00e1vcem \u00fadaj\u016f.<\/p><p>&#8211; Pro \u00fa\u010dely slu\u017eby SmartDelay bude spole\u010dnost Collinson Service Solutions Limited p\u016fsobit jako nez\u00e1visl\u00fd spr\u00e1vce \u00fadaj\u016f. Osobn\u00ed \u00fadaje z\u00e1kazn\u00edk\u016f budou sd\u00edleny se spole\u010dnost\u00ed Collinson v\u00fdhradn\u011b na z\u00e1klad\u011b t\u00e9to smlouvy a pouze v rozsahu nezbytn\u00e9m pro poskytov\u00e1n\u00ed slu\u017eby SmartDelay. <\/p><p>7.7. Any dispute, controversy or claim, arising out of or relating to the T&amp;C, its breach, termination or validity shall be finally settled in the respective court of the Republic of Lithuania subject to the rules of jurisdiction unless mandatory provisions of law specify otherwise. Disputes related to SmartDelay service shall be governed by the <a href=\"http:\/\/travelwithcare.io\/cs\/smartdelay-terms-and-conditions\/\">SmartDelay Terms and Conditions<\/a> and resolved under English law in the exclusive jurisdiction of English courts. <\/p><p>7.8. Pokud bude jak\u00e9koli ustanoven\u00ed VOP shled\u00e1no soudem nebo rozhod\u010d\u00edm soudem nez\u00e1konn\u00fdm, neplatn\u00fdm nebo nevymahateln\u00fdm, ostatn\u00ed ustanoven\u00ed VOP z\u016fstanou v pln\u00e9 platnosti a \u00fa\u010dinnosti. Jak\u00e9koli ustanoven\u00ed VOP, kter\u00e9 bude shled\u00e1no nez\u00e1konn\u00fdm, neplatn\u00fdm nebo nevymahateln\u00fdm pouze \u010d\u00e1ste\u010dn\u011b nebo do ur\u010dit\u00e9 m\u00edry, z\u016fstane v pln\u00e9 platnosti a \u00fa\u010dinnosti v rozsahu, v jak\u00e9m nen\u00ed shled\u00e1no nez\u00e1konn\u00fdm, neplatn\u00fdm nebo nevymahateln\u00fdm. Spole\u010dnost Skycop uprav\u00ed VOP nahrazen\u00edm takov\u00fdch nez\u00e1konn\u00fdch, neplatn\u00fdch nebo nevymahateln\u00fdch ustanoven\u00ed z\u00e1konn\u00fdmi, platn\u00fdmi a vymahateln\u00fdmi ustanoven\u00edmi, kter\u00e1 povedou k v\u00fdsledku co nejbl\u00ed\u017ee z\u00e1m\u011br\u016fm spole\u010dnosti Skycop a klienta. Spole\u010dnost Skycop vynalo\u017e\u00ed ve\u0161ker\u00e9 \u00fasil\u00ed k zaji\u0161t\u011bn\u00ed proveden\u00ed v\u0161ech ustanoven\u00ed t\u011bchto VOP.   <\/p><p>7.9.
